KRAFTSPACE TERMS & CONDITIONS

1. Acceptance

These Terms & Conditions (“Terms”) form a binding agreement between you and [KraftSpace Legal Entity Name]. By accessing the Services, creating an account, posting a project, creating a professional profile, submitting a proposal or purchasing a paid feature, you agree to these Terms and the Privacy Policy.

2. Marketplace Role

KraftSpace is a technology marketplace connecting clients and professionals. Unless a separate written agreement states otherwise, KraftSpace is not the architect, designer, contractor, consultant, employer, agent, insurer, project manager or contracting party merely because it operates the marketplace.

KraftSpace does not guarantee a professional's suitability, licence, availability or performance, or a client's authenticity, solvency or likelihood of awarding a project. Users must independently verify credentials, licences, references, insurance, scope, pricing and contractual terms.

3. Eligibility and Accounts

Users must provide accurate and current information and protect account credentials.

Businesses/studios must ensure account administrators have authority to act for the business.

KraftSpace may require identity, business, professional or project verification.

Users must promptly report unauthorized account access.

4. Professional Profiles

Professionals must accurately represent qualifications, services, experience, portfolio, project history, locations, availability, ratings and other profile information.

Do not claim licences/certifications or project experience you do not possess. Clearly identify academic, internship, conceptual and personal work.

Do not upload portfolio material without the rights necessary to share it.

5. Client Projects

Clients must provide accurate project requirements, budgets, timelines, site information and documents.

Clients are responsible for approvals, permissions, surveys, legal checks and professional advice required for their projects.

Users must not post fraudulent, unlawful, discriminatory or misleading requirements.

6. KAI and AI Services

KAI may generate structured forms, suggestions, search results, match scores, explanations and recommendations.

KAI outputs are informational and may be inaccurate or incomplete. They are not professional, legal, financial, architectural, engineering, construction or other regulated advice.

Match scores are estimates and do not guarantee hiring, quality, availability, project success or compatibility.

Users remain responsible for reviewing and validating submitted information and important AI-generated recommendations.

7. Matching and Ranking

KraftSpace may rank professionals/projects using category, subcategory, project type, services, budget, area, style, location, timeline, experience, similar projects, availability, ratings, response metrics and other signals.

Membership may affect visibility or features where disclosed, but membership is not a guarantee of selection.

KraftSpace may apply fraud-prevention, quality, availability and marketplace-integrity adjustments.

Users must not manipulate views, reviews, shortlists, proposals or ranking signals.

8. Visibility and Contact Protection

Projects may be Open, Invite Only or Private. Visibility settings determine the intended discovery audience but do not guarantee absolute confidentiality.

Contact information may be hidden until a valid contact-unlock or other eligibility condition is satisfied.

Users may not bypass technical, payment or privacy controls or use another person's contact information for unrelated purposes.

9. Fees, Memberships and Contact Unlocks

KraftSpace may charge for memberships, subscriptions, contact unlocks, premium features or other services. Checkout will display applicable price, currency, taxes and billing terms.

A contact-unlock fee purchases access to the specified contact information/service; it does not guarantee a response, proposal, engagement or project award.

Completed contact unlocks may be non-refundable once contact information has been revealed, subject to mandatory law and the applicable refund policy.

Membership cancellation normally stops future renewal; current-period refunds are governed by the plan/refund policy and mandatory law.

10. Payments

Payments may be processed by third-party providers. Users must comply with their applicable terms. KraftSpace may receive transaction IDs and payment status. Reversed, fraudulent or disputed transactions may cause paid features to be suspended, subject to law.

11. Proposals, Shortlisting and Hiring

Professionals are responsible for their proposals, quotes, timelines, deliverables and commercial terms.

Clients are responsible for evaluating proposals and selecting professionals.

Shortlisting does not create a contract. Hiring should be followed by an appropriate agreement covering scope, deliverables, milestones, fees, taxes, IP, confidentiality, liability, termination and dispute terms.

12. Project Execution

Where KraftSpace provides milestones, documents, messages, payment tracking or execution tools, those tools facilitate administration and communication. Unless expressly agreed in writing, KraftSpace does not supervise work or guarantee project outcomes.

Project Status, Professional Application Status, Execution Status, Payment Status and Support Status are separate systems.

13. User Content and IP

You retain ownership of content you submit, subject to rights granted to others. You grant KraftSpace a limited licence to host, process, reproduce, display and transmit your content as necessary to operate, secure and improve the Services, including discovery and matching.

You represent that you have the rights required to upload and share content.

KraftSpace owns or licenses its software, branding, UI, taxonomy implementation, documentation and platform materials.

14. Prohibited Conduct

• Fraud, impersonation, fake credentials or material misrepresentation.
• Infringing, unlawful, defamatory, harassing, malicious or deceptive content.
• Unauthorized scraping, crawling, reverse engineering or data extraction.
• Bypassing contact unlocks, access controls, privacy controls or payments.
• Manipulating reviews, views, shortlists, proposals or ranking signals.
• Spam, phishing, malware, unauthorized commercial communications or attacks on the platform.
• Using another user's private information outside the purpose for which it was disclosed.
• Using KAI output as a substitute for required professional or regulatory advice.

15. Reviews and Ratings

Reviews must reflect genuine experience. Users may not buy/sell fabricated reviews or coordinate rating manipulation. KraftSpace may moderate or remove content consistent with applicable law and its policies.

16. Communications

Users are responsible for communications they send. KraftSpace may retain communication content/metadata as described in the Privacy Policy for service operation, safety, support and dispute resolution.

17. Suspension and Termination

KraftSpace may suspend, restrict or terminate accounts for material breach, fraud, unlawful conduct, safety risks, payment abuse, repeated violations or risks to users/platform.

Termination does not remove obligations that by nature survive, including payment, IP, confidentiality, indemnity, liability and dispute provisions.

18. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”. KRAFTSPACE DOES NOT WARRANT THAT THE SERVICES, MATCHES, PROFESSIONALS, PROJECTS, REVIEWS, PRICES, TIMELINES OR AI OUTPUTS WILL BE ACCURATE, COMPLETE, SECURE, UNINTERRUPTED OR SUITABLE.

19. No Professional Advice

KraftSpace is a technology marketplace. Users must obtain advice from appropriately licensed architects, engineers, lawyers, accountants, contractors or other professionals whenever required.

20. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KRAFTSPACE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, GOODWILL OR BUSINESS ARISING FROM THE SERVICES. Subject to mandatory law, aggregate liability should be capped at the greater of the amount paid to KraftSpace for the relevant Service during the preceding [6/12] months or [₹X]. This clause requires jurisdiction-specific legal review.

21. Indemnity

To the extent permitted by law, you agree to defend, indemnify and hold harmless KraftSpace and its affiliates, officers, employees and service providers from claims/losses arising from your breach, unlawful conduct, infringement, fraud or misuse of the Services.

22. Governing Law and Disputes

Governing law: [State, India]. Courts/tribunals: [City, State, India], subject to applicable mandatory law. If arbitration is intended, counsel should replace this clause with a complete arbitration provision specifying seat, rules, arbitrator count and language.

23. Mandatory Consumer/Data Rights

Nothing in these Terms excludes or restricts rights that cannot lawfully be excluded under applicable consumer, data-protection, competition or other mandatory law.

24. Changes

KraftSpace may modify features, pricing, taxonomy, membership benefits, matching logic and other Services. We may update these Terms; material changes will be communicated where required.

If a provision is unenforceable, the rest remains effective. Failure to enforce is not a waiver. Assignment is restricted except as permitted. Electronic communications and notices may be used subject to applicable law.
